Terms of Service

These Terms of Service ("Terms") govern your use of TotumSnap ("Service"), operated by Patrick Colligan ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using TotumSnap, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

TotumSnap is a web-based tool that crawls websites and captures full-page screenshots, packaging them into downloadable ZIP files. The Service is intended for designers, developers, and agencies conducting website research, audits, and redesign projects.

3. Eligibility

You must be at least 18 years old to use TotumSnap. By using the Service you confirm you meet this requirement. The Service is intended for business and professional use.

4. Your Account

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Ensuring your account information is accurate and up to date

Notify us immediately at support@totumsnap.com if you suspect unauthorized access to your account.

5. Acceptable Use

You agree to use TotumSnap only for lawful purposes. You must not:

  • Crawl websites you do not have permission to access
  • Use the Service to scrape, copy, or reproduce copyrighted content for commercial distribution without authorization
  • Attempt to circumvent rate limits, plan restrictions, or access controls
  • Use the Service to conduct denial-of-service attacks or overload third-party servers
  • Reverse engineer, decompile, or attempt to extract the source code of TotumSnap
  • Resell or sublicense access to the Service without our written permission
  • Use the Service for any illegal purpose or in violation of any applicable law

You are solely responsible for the URLs you submit and the content of the screenshots you capture. We are not responsible for any legal claims arising from your use of captured content.

6. Crawling Third-Party Websites

When you submit a URL to TotumSnap, you represent and warrant that:

  • You have the legal right to crawl and screenshot that website
  • Your use complies with that website's Terms of Service and robots.txt directives
  • You will not use the captured screenshots in a way that violates any third party's intellectual property rights

We reserve the right to block crawls of specific domains at our discretion.

7. Subscriptions and Billing

Plans

TotumSnap offers the following plans:

  • Free — 3 crawls/month, up to 25 pages per capture
  • Pro — $19/month, 30 crawls/month, up to 200 pages per capture
  • Agency — $49/month, unlimited crawls, up to 500 pages per capture

Billing

  • All payments are processed by Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring monthly basis.
  • Subscriptions automatically renew at the end of each billing period unless cancelled.
  • Prices are in USD and exclusive of any applicable taxes.

Cancellation

  • You may cancel your subscription at any time from your account Settings page.
  • Cancellation takes effect at the end of the current billing period. You retain access to paid features until then.
  • We do not offer partial-month refunds.

Refunds

  • We offer a full refund within 7 days of your first payment if the Service does not work as described. Contact support@totumsnap.com.
  • After 7 days, all payments are non-refundable except where required by law.

8. Free Plan Limitations

The Free plan is subject to usage limits as described above. We reserve the right to modify Free plan limits at any time with notice. Abuse of the Free plan (including creating multiple accounts to circumvent limits) may result in account termination.

9. Data and Storage

  • Free plan ZIP files are stored for 24 hours after capture.
  • Pro and Agency plan ZIP files are stored indefinitely while your account is active.
  • Upon account closure, all stored files and job records are deleted within 30 days.
  • We are not responsible for loss of data due to service interruptions, bugs, or third-party failures. You should download and save your ZIP files promptly.

10. Intellectual Property

TotumSnap and all associated code, design, trademarks, and content are owned by Patrick Colligan. Nothing in these Terms grants you any right to use our trademarks, logos, or brand elements.

You retain ownership of any screenshots and ZIP files you download. We claim no ownership over the content of your captures.

11. Service Availability

We aim for high availability but do not guarantee uninterrupted access to the Service. We may temporarily suspend the Service for maintenance, upgrades, or circumstances beyond our control. We are not liable for any losses resulting from service downtime.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Crawls will successfully access all pages on a given website
  • Screenshots will accurately represent the visual appearance of every page
  • The Service will work on websites protected by bot detection, authentication, or other access controls

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PATRICK COLLIGAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM OR (B) $50.

14. Indemnification

You agree to indemnify and hold harmless Patrick Colligan from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third party's rights.

15. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct we determine to be harmful to the Service or other users. You may close your account at any time from Settings.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, United States. Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in New York, and you consent to personal jurisdiction in those courts.
